President Joe Biden’s former non-binary nuclear waste guru Sam Brinton walked out of a Minnesota court after a preliminary hearing on luggage theft charges on Wednesday.
Brinton, the former deputy assistant secretary for spent fuel and waste disposition at the Department of Energy’s Office of Nuclear Energy, could face up to five years in prison and/or a $10,000 fine if found guilty.
According to the complaint, Brinton removed a tag from a woman’s luggage and walked out with the bag at Minneapolis-St. Paul Airport on September 16. The items inside were appraised at $2,325.
American Airlines later confirmed that Brinton had not checked a bag on their flight from Washington D.C. The victim was shown footage of Brinton with the suitcase, she confirmed that it was her luggage. In court Wednesday Brinton was ordered not to have any contact with the victim.
In court, the judge referred to Brinton as Mx Brinton. Mx is a common gender-neutral title given to non-binary people who do not wish to have a gender referred to in their title.

Independent photojournalist Rebecca Brannon recorded Brinton exiting the court. They ignored reporter’s questions including, ‘Why would you want some lady’s dirty clothes?’
Anothe reporter asked if Brinton was there to have a job interview with Minnesota Governor Tim Walz’s administration.
Another asked if they had visited ‘the Larry Craig restroom,’ a reference for former Republican Senator Larry Craig who was arrested for lewd conduct in a bathroom at Minneapolis-St. Paul International Airport in 2007.
When Brinton returned to the nation’s capital two days later, they checked the bag as if it was theirs. The nuclear scientist then used the bag on a trip to Europe in October.
Brinton was contacted by investigators and lied initially saying they had not taken the bag. They later admitted to the crime but claimed it was an accident.
They also said that they had left the woman’s clothing in a hotel room in St. Paul, however it was never recovered.
In a separate incident, Brinton is accused of stealing a different woman’s luggage from Harry Reid International Airport in Las Vegas.
They appeared in court in December on those charges and was freed on a $15,000 bail.
A security footage image showed Brinton walking through Harry Reid International Airport with the luggage during the summer.
The $320 case, which was lifted from a carousel, was stuffed with more than $3,000-worth of jewelry, clothes and makeup, according to 8 News Now Investigators.
It is unclear why they targeted the suitcase or if it was because it was from a luxury brand.

Brinton was laid off from their Department of Energy job after being accused of stealing luggage in two separate incidents at the Las Vegas airport and the Minneapolis airport
Prior to Wednesday’s appearance, Brinton’s lawyers had repeated attempts to have the former Biden official attend the hearing remotely. Their lawyers referred to their ’employment issues’ and media attention as the reason for the request.
The hearing was originally supposed to take place on December 19. A few days prior to that original date, Brinton was fired by the Department of Energy.
A spokesperson said: ‘Sam Brinton is no longer a DOE employee. By law, the Department of Energy cannot comment further on personnel matters.’
It’s unclear if Brinton resigned of their own accord, if they were fired – or if they were given the chance to resign before being fired.
The White House has repeatedly refused to comment on the scandal, claiming it is a non-political issue.
The Department of Energy has also tried to distance Biden from the issue.
Brinton was appointed in June with much fanfare.
‘Sam is also a well-known advocate for LGBTQ youth and helped to secure protections against the dangerous and discredited practice of conversion therapy in more than half of the country,’ it said.
‘They identify as gender-fluid and use the pronouns they, them, and theirs,’ their bio reads.
On top of working in the Department of Energy, they also held seminars including a recent event on spanking.
Brinton lives in Washington DC with their husband.
