One of Danny Masterson’s three accusers told the jury at his trial Tuesday that the Scientologist actor raped her anally while she was unconscious – then laughed at her when she confronted him about it.

And when Jane Doe #3 reported him to the Church of Scientology, she was told, ‘There was something I had done to deserve what he (Masterson) was doing to me.’  

Jane Doe #3 – who became so emotional at one point that the judge had to call a 10-minute recess – told the court about a night in December 2001 when she and Masterson went to the LA bistro La Poubelle where they had dinner and she had ‘a glass or two of wine.’

‘I remember getting up to leave, but I don’t have any memory after that,’ she said.

The next thing she remembered, she told the jury, was waking up the next day, naked in bed at Masterson’s house where she lived with him.

‘I felt confused and I noticed my whole body hurt. The back of my head hurt and I noticed that I was injured in my bottom, my butt. My anal area was injured.

‘I went to the bathroom and saw that my anal area was not normal – it was torn and there was a little bleeding. I was feeling a lot of pain and I could not sit down.’

She went downstairs to look for Masterson and found him sitting in is office where, she said, ‘I asked him what happened last night? I asked him if I had fallen because I was hurting “down there”.

‘He laughed at me and said he had sex with me there.

‘I asked him if I had been unconscious the whole time and he said yes.’  

As she sobbed on the witness stand, Jane Doe #3 went on, ‘It broke my heart. Because I really trusted him and I did not believe he would take it that far.’ 

Masterson, 46, is accused of raping three women at his Hollywood Hills home between 2001 and 2003. He’s pleaded not guilty to all the charges.

He is facing a sentence of 45 years to life in prison if he’s convicted at the end of his trial where Elvis Presley’s daughter, ex-Scientologist Lisa Marie Presley, is on the witness list.

The That ‘70s Show star, who has been free on $3.3 million bail since his arrest in June 2020,  showed up Tuesday in a dark blue suit and gray shirt and tie for the sixth day of his rape trial at criminal court in downtown Los Angeles.

His accusers – who DailyMail.com is identifying only as Jane Does 1 through 3 – are all former Scientologists and are also suing the That ’70s Show star and the Church of Scientology in civil court, claiming that they’ve been harassed and intimidated since reporting him to police.    

Asked by Deputy District Attorney Reinhold Mueller if she reported Masterson to the police, Jane Doe #3 explained that she did not because, as a Scientologist, she believed at that time that ‘the only justice system was Scientology’.

So, a day or two after the alleged rape she went to Scientology’s Celebrity Center in Hollywood to see her ‘ethics officer’ and report it.

 ‘I told her that he raped me,’ Jane Doe #3 told the jury. ‘I told her that he was sexually assaulting me and that I could not say no. And if I did say no it turned into an ugly fight.

The woman said the ethics officer stopped her and told her not to use the word rape. “She explained to me that you cannot rape someone you are in a relationship with.

‘I believed her – she was the ethics officer and I trusted her. She told me I had done something to cause it. There was something I had done to deserve what he (Masterson) was doing to me.’

A Scientology chaplain told her that ‘my job as Masterson’s girlfriend was that if I didn’t say no, it would not happen,’ the court heard. 

‘My job as his girlfriend….was to give him sex whenever he wanted. He provided for me so I needed to match that.’

She told the court that on the instructions of her ethics officer she went through a month-long ‘ethics course’ because she was afraid that she would be branded a ‘suppressive person’, cut off by other Scientologists.

‘It scared me – so I just did as I was told,’ she said, adding that if she had been declared a ’suppressive person, ‘I’m afraid I would not have survived that at that time.’

Jane Doe #3 and Masterson split up around February/March 2002 and they went together to Scientology officials to go sign the ‘terms of their breakup.’

Asked about those terms she said, ‘I remember I was not to sue him.’

They stayed in contact after their split and, she admitted, were intimate with each other again, twice in LA and once in New York where she moved about year after their breakup.

Why did she get together for sexual hookups with Masterson again after they had broken up? she was asked.

‘I loved him, ‘ she responded. ‘I care about him very much.’

The testimony came on the second day Jane Doe #3 was on the stand. On Monday she told the court that the actor would urinate on her, call her ‘white trash,’ be physically abusive toward her and regularly force her to have sex against her will.

Last week Jane Doe #1 described how Masterson allegedly threw her in his jacuzzi, raped her and then pulled a gun on her, telling her, ‘Don’t say a f***king word.’ 

Jane Doe #3 was a successful model, barely 18, when she met Masterson in 1996 and soon moved in with him, the court heard.

‘It was good for the first year – he was very charming and I fell for him,’ she said.

The Scientologist TV star grew tired of her traveling around the world on modeling assignments and asked her to stay at home. ‘His religion discusses this – women should stay home,’ she told the court.

He also urged her join the Church of Scientology, she added. ‘He made it very clear to me that I must become a Scientologist. In order to remain in this relationship I needed to start doing [Scientology] courses. 

‘I was told that my parents were suppressive people and I disconnected with my family. He [Masterson] did not like any of my friends – so my new friends were Scientologists.

Masterson mingled with some of Hollywood’s biggest names. In 2009 he was with Eva Longoria, Simon Cowell and then-Scientologist Leah Remini at a fundraiser for 9/11 first responders

‘My entire life became his friends and family and his church.’

Jane Doe #3 told the jury that about a year into their relationship, Masterson changed.

‘He became very aggressive sexually – and I recall some physical abuse and emotional.

‘I remember coming back from Paris and I was really tired and jet-lagged and he wanted to have sex and I didn’t.

‘It resulted in a fight and he dragged me by my hair across the bedroom floor. He called me fat and other insults.’

She told the court that incidents of Masterson wanting sex when she didn’t became more frequent. ‘It became pretty regular – I just let it happen.’

Jane Doe #3 said that on these occasions it would be she, not him, who would say sorry.

‘I would apologize to him – if I didn’t, he would be very angry. He would not talk to me. I felt like it was my fault. He was always right…

‘He would want to have sex, I would tell him no and he’d have sex anyway. You just don’t say no to him.’

She told the jury that when Masterson was angry at her, ‘He would call me white trash.’

She also said that he ‘would urinate on me. I would be in the shower and he would sneak in and pee on me. He thought it was funny.’

Jane Doe #3 said that her relationship with Masterson changed – and was on the way to ending – in late 2001 ‘when I started sort of sticking up for myself.’

Fighting back tears, she recalled a night in November 2001 when, ‘I was sleeping and woke up and he was having sex with me. I didn’t want to have sex with him so I said, ‘No, I don’t want to…

‘But he wouldn’t stop. I tried to push him off but he put all his body weight down on me. He pushed my arms back – I felt trapped.

‘I was able to to get my left hand free and do something I knew would get him off of me. I pulled his hair. He has these rules – no touch face rule and no touch hair rule.’

Asked by Deputy DA Mueller how Masterson reacted when she pulled his hair, she said, ‘He hit me hard on the face with his hand.

‘When he hit me I was shocked by it. I was angry. I was screaming, ‘Get off me.’

‘At that point he got up, stood over me and spit on me. And he called me white trash.’
